Warranty Terms and Conditions Climate King BV

1. General provisions

1.1. These warranty terms apply in full to all products supplied by Climate King BV to consumers within the European Union, without prejudice to the mandatory consumer protection as laid down in the national legislation of the consumer’s member state.
1.2. The warranties stated below are additional and restrictive alongside the consumer’s legal rights and in no way limit the protection to which the consumer is entitled under national legislation.
1.3. Warranty issues must be submitted exclusively via the digital communication method designated by Climate King BV, namely the contact form on the website, accompanied by relevant purchase documentation, serial numbers of the unit(s) concerned, and a detailed description of the defects found.

2. Manufacturer’s warranty and carry-in warranty

2.1. For all products delivered in the Netherlands, a manufacturer’s warranty of five years applies to split air conditioning systems and two years for mobile air conditioning systems, starting from the date of delivery, unless otherwise indicated in writing.
2.2. During the warranty period, defective parts will be replaced free of charge or, at the discretion of Climate King BV, repaired, provided that the products have been used in accordance with the supplied user manuals, installation guidelines, and other instructions from Climate King BV.
2.3. The warranty only covers the material costs of the parts to be replaced or repaired; labor costs, disassembly, assembly, transport costs, and any other form of direct or indirect consequential damage are excluded.
2.4. The warranty is a carry-in warranty, which means that defective products must be brought by the consumer to the return address designated by Climate King BV, or, by mutual agreement, can be collected. All costs and risks associated with transport and return delivery are entirely at the consumer’s expense. The product cannot be repaired on-site by Climate King BV, and collection/return can take place at a later agreed time.

3. Obligations of the consumer for warranty claims

3.1. To submit a warranty claim, the consumer is required to provide a valid purchase invoice for the entire installation, including the serial numbers of the unit(s) involved.
3.2. The product must have been installed and used in accordance with the installation guidelines prescribed by Climate King BV. Furthermore, the nature of the defect, including any error codes, must be reported.
3.3. All returns of defective products must be correctly, safely, and adequately packaged, with the risk of transport being entirely at the consumer’s expense.

4. Warranty exclusions

4.1. The warranty does not apply if the defect or damage was caused by external circumstances, including but not limited to natural elements, vandalism, overvoltage or undervoltage, or other extraordinary influences.
4.2. Damage or defects resulting from overdue maintenance, severe contamination, placement in an aggressive or corrosive environment, incorrect installation, or other forms of improper use are not covered by the warranty.
4.3. Defects resulting from insufficient capacity of the product for the intended application, removal or illegibility of the type plate, or the absence of an identification plate on the outdoor unit are excluded from the warranty.
4.4. Labor costs, external costs, transport costs, and consequential damage from defects are explicitly excluded.
4.5. Products that are so damaged, contaminated, or modified that inspection, repair, or resale is impossible are also excluded from the warranty.

5. Procedure for warranty claims

5.1. Warranty claims must be submitted without undue delay, but within a reasonable period after discovery of the defect, via the Climate King BV contact form, with complete and correct purchase documentation, serial numbers, and a detailed description of the defect.
5.2. After assessing the submitted claim, Climate King BV reserves the right, at its own discretion, to replace the defective part, repair it, or provide a replacement product, provided that the product has been correctly returned or collected by agreement.
5.3. The return of the defective product must be made to the return address designated by Climate King BV, with all costs and risks associated with transport being borne in full by the consumer.

6. Applicable law and European consumer protection

6.1. These warranty terms are governed by Dutch law, without prejudice to the mandatory consumer rights under national legislation in his or her member state within the European Union.
6.2. Consumers retain at all times the legal rights and protection to which they are entitled under the relevant consumer legislation within their member state, taking into account EU regulations regarding consumer protection and warranty.
6.3. Nothing in these warranty terms shall be construed as a limitation of the consumer’s legal rights, as protected by mandatory provisions within the member states of the European Union.
