Right of withdrawal<\/h1>\n

1. Scope of the right of withdrawal<\/h3>\n

1.1. The right of withdrawal applies exclusively to natural persons acting outside the scope of a profession or business who have entered into a distance agreement with Climate King BV within a member state of the European Union.
\n1.2. Agreements concluded with business customers are expressly excluded from the right of withdrawal. <\/p>\n

2. Withdrawal period<\/h3>\n

2.1. The consumer has the right to withdraw from the agreement without giving any reason within a period of fourteen days.
\n2.2. This period begins on the day the consumer, or a third party designated by the consumer who is not the carrier, has taken physical possession of the product.
\n2.3. If an order consists of multiple products delivered separately, the withdrawal period begins on the day the last product is received. <\/p>\n

3. Method of withdrawal<\/h3>\n

3.1. To validly exercise the right of withdrawal, the consumer must unequivocally state their wish to withdraw from the agreement within the withdrawal period.
\n3.2. Withdrawal must be made via the contact form on the Climate King BV website.
\n3.3. A return form is available on this page, which must be completed fully and truthfully by the consumer.
\n3.4. The completed return form must be included with the returned products.
\n3.5. The burden of proof for timely and correct withdrawal lies entirely with the consumer. <\/p>\n

4. Obligations of the consumer after withdrawal<\/h3>\n

4.1. After withdrawal, the consumer is obliged to return the products as soon as reasonably possible and in their current condition to the return address designated by Climate King BV.
\n4.2. All costs associated with the return shipment, including but not limited to shipping costs, packaging materials, and any additional logistical or customs costs, are entirely at the consumer’s expense. These costs may vary per European Union member state and depend on the transport method chosen by the consumer.
\n4.3. The consumer bears the full risk of loss, damage, or other adverse consequences that may occur during the transport of the return shipment until the products are actually received by Climate King BV and inspected by us.
\n4.4. The fourteen-day period mentioned in Article 2 applies exclusively to the consumer’s right to withdraw from the agreement and does not impose an obligation on the consumer to ship the products within a specific timeframe. However, the consumer must exercise reasonable speed when returning the items. <\/p>\n

5. Inspection, depreciation, and refund<\/h3>\n

5.1. Upon receipt of the return shipment, Climate King BV will inspect the products for completeness, damage, signs of use, and contamination.
\n5.2. If the product has been used in a manner that goes beyond what is necessary to establish its nature, characteristics, and functioning, Climate King BV is entitled to apply a reduction in value.
\n5.3. This depreciation can, depending on the condition of the product, amount to up to one hundred percent of the purchase price.
\n5.4. Refunds will only be issued after Climate King BV has actually received and inspected the return shipment.
\n5.5. The refund includes the purchase price plus the standard shipping costs charged by Climate King BV for the initial delivery, minus any depreciation.
\n5.6. Refunds are made using the same payment method used for the original transaction, unless expressly agreed otherwise. <\/p>\n

6. Exclusions from the right of withdrawal<\/h3>\n

6.1. The right of withdrawal is excluded for products that are not suitable for return for reasons of hygiene or health protection and whose condition has changed after delivery.
\n6.2. For air conditioning systems, the right of withdrawal expires if the hygiene filters are contaminated or if the product has been used in such a way that it cannot be resold without additional actions.
\n6.3. Testing products within the withdrawal period is permitted, provided it is limited to what is necessary to establish the nature, characteristics, and functioning and does not cause permanent changes or contamination. <\/p>\n

7. Applicable law and consumer protection<\/h3>\n

7.1. These provisions have been drafted in accordance with Dutch law.
\n7.2. To the extent that mandatory consumer protection in the consumer’s member state applies, the consumer retains all legal rights in accordance with the regulations of their state of residence within the European Union.
